By accessing or using our assets or services, you enter into a legally binding agreement with Jeqo, an entity operating under the laws of California, and agree to comply with these legal terms. Please carefully review the terms outlined below before proceeding.
For the purposes of these legal terms:
Jeqo specializes in the creation of bespoke assets tailored to the Client's specifications. Jeqo provides Clients with lifetime licenses, granting them exclusive rights to utilize and display the assets for promotional purposes. These licenses are non-transferable and remain the property of Jeqo.
Our pricing structure is transparent and based on a per-asset basis. Clients are invoiced for each asset created, with fees rounded to the nearest dollar. Additional charges may apply for services rendered beyond the initial scope, billed at a flat rate per half-hour.
Due to the digital nature of our services and the custom-tailored nature of our assets, Jeqo operates under a strict no-refund policy. All sales are final, and refunds will not be issued under any circumstances.
While Clients are granted limited usage rights under our licensing agreements, Jeqo retains full ownership of the intellectual property rights associated with all assets created. Unauthorized distribution, reproduction, or modification of assets is strictly prohibited and may result in legal action.
Partnerships and collaborations with third parties require formal agreements to be established in advance. Any third-party involvement in asset creation or utilization is subject to additional licensing fees and contractual obligations.
Jeqo reserves the right to terminate agreements with Clients in the event of breach of contract, non-payment, or misconduct. Such termination may result in penalties or legal action. Additionally, Jeqo retains the right to blacklist individuals or entities involved in fraudulent activities or copyright infringement. Termination procedures will include a notice period and opportunity for resolution before enforcement.
Jeqo reserves the right to utilize produced assets for promotional purposes, including but not limited to marketing materials and portfolio showcases. Clients are prohibited from using assets for unauthorized purposes, including software development, giveaways, or public distribution, without explicit written consent from Jeqo. Usage restrictions may apply to specific platforms or types of promotional materials.
In the event of any dispute arising between Jeqo and a Client, the parties agree to engage in good faith negotiations to resolve the dispute. If the dispute cannot be resolved amicably through negotiation, the parties agree to escalate the matter to mediation, facilitated by a recognized mediation provider such as the American Arbitration Association (AAA) or JAMS (Judicial Arbitration and Mediation Services). If mediation is unsuccessful in resolving the dispute, the parties agree to submit to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA) or the Comprehensive Arbitration Rules and Procedures of JAMS (Judicial Arbitration and Mediation Services).
These legal terms shall be governed by and construed in accordance with the laws of California, without regard to its conflict of law principles. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of California.
The Client agrees to indemnify, defend, and hold harmless Jeqo, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to the Client's breach of these legal terms or violation of any applicable law or regulation.
Jeqo reserves the right to modify or update these legal terms at any time without prior notice. Any changes will be effective immediately upon posting the updated terms on the Jeqo website. Clients are responsible for regularly reviewing the terms and acknowledging their acceptance of any modifications or updates.
Jeqo reserves all rights not expressly granted in these legal terms. No waiver of any provision of these terms shall be deemed a further or continuing waiver of such provision or any other provision.
